Independent safeguarding investigations
Reportable conduct investigations
When an allegation involving a child is raised against a worker, organisations must respond quickly, fairly and transparently. We provide independent, trauma-informed reportable conduct investigations that protect children, respect procedural fairness and satisfy regulator expectations.
What is a reportable conduct investigation?
A reportable conduct investigation is an administrative investigation run by an organisation covered by a reportable conduct scheme. Its purpose is to determine whether an allegation of child abuse or misconduct by an employee, volunteer or contractor is substantiated, and what organisational response is required.
It is not a criminal investigation. The standard of proof is the balance of probabilities, and the process must be child-focused, confidential and procedurally fair to the person who is the subject of the allegation.
When to engage an independent investigator
Many organisations have capable internal teams, but some situations call for an independent investigator. These include:
- The allegation involves a senior leader, board member or person with conflict of interest over the investigation
- The matter has attracted media, regulatory or funding-body attention
- Internal resources are too close to the parties or lack specialised investigation experience
- The organisation needs to demonstrate independence to a regulator, court or stakeholder
- The allegation is complex, historical or involves multiple complainants or witnesses
An external investigator can also help when an organisation simply needs capacity — for example, during a sudden surge of complaints, a restructure, or a period of heightened regulatory scrutiny.
How our investigations work
Every investigation we lead is tailored to the organisation, the jurisdiction and the nature of the allegation. Our typical process includes:
- Intake and scoping — we review the complaint, identify risks, confirm terms of reference and agree reporting lines and timeframes.
- Risk assessment — we assess immediate child-safety risks and advise on interim measures such as suspension, supervision or contact restrictions.
- Evidence gathering — we collect and review documents, correspondence, policies, incident reports and other records relevant to the allegation.
- Interviews — we interview the complainant, the subject of the allegation and witnesses, using trauma-informed techniques and clear interview plans.
- Analysis and findings — we weigh the evidence, apply the balance of probabilities test, and make clear findings about whether reportable conduct occurred.
- Report and recommendations — we deliver a concise, regulator-ready report with findings, reasoning and practical recommendations for organisational action.
Jurisdictions we support
We support organisations across Australia. Our team is based in Queensland and works with clients subject to reportable conduct schemes in:
- New South Wales — under the NSW Ombudsman and Office of the Children's Guardian
- Victoria — under the Commission for Children and Young People
- Australian Capital Territory — under the ACT Human Rights Commission
- Queensland — where a legislated scheme is not yet in place, but Child Safe Standards and funding-agreement obligations still require thorough, defensible investigations
For organisations operating nationally, we help map overlapping obligations and ensure one investigation process can meet multiple reporting requirements where possible.
